Terms of Service

1. The Service

ConeLab provides Cone Voice, a desktop application that converts spoken audio into text. The Service is operated by ConeLab, a one-person studio.

2. Eligibility

You must be at least 13 years old (16 in the European Economic Area or United Kingdom) to use the Service. By creating an account, you represent that you meet this requirement.

3. Your account

Creating an account. Accounts are created at conelab.ai or directly in the Cone Voice desktop app. You sign in by entering your email address; we then send a 6-digit verification code to that email; you enter the code to complete sign-in. We do not use passwords, and we do not offer third-party single-sign-on (such as Google, Apple, or GitHub). You must provide a valid email address that you control and have continuous access to.

One account per person. You may have only one account. You may not share your account, transfer it to another person, or create multiple accounts to circumvent free-plan quotas, trial periods, or other limits.

Account security. You are responsible for safeguarding access to your account and for all activity under your account. Notify us immediately at hello@conelab.ai if you suspect unauthorized access.

Email security. Because email-delivered verification codes are the only authentication channel for the Service, the security of your email account is critical: anyone who can read your email can sign in to your Cone Voice account. We strongly recommend that you (a) enable two-factor authentication on your email account, (b) use a strong, unique password for it, and (c) review your email account's recovery options. We are not responsible for unauthorized access to Cone Voice that results from compromise of your email account.

Account information accuracy. You agree to keep your account information (including email address) current. We may use your email to send essential service messages, billing notices, and security alerts.

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use Cone Voice on devices you own or control, for your personal or internal business use, in accordance with these Terms.

You may not:

• Reverse engineer, decompile, or disassemble the application except where permitted by law
• Modify or create derivative works of the application
• Remove or alter copyright, trademark, or other proprietary notices
• Resell, sublicense, or redistribute the Service
• Use the Service to violate any law or third-party right

5. Subscriptions, billing, refunds

Plans. Cone Voice is offered in three tiers, each with a monthly transcription quota:

• Free — 60 minutes per month. No payment information required.
• Pro — 30 hours per month.
• Max — 60 hours per month.

Quota cycle. Quotas are per-user and renew on a monthly cadence aligned with your individual cycle date — they do not reset on the calendar 1st of every month. For paid plans (Pro and Max), your quota cycle aligns with your subscription's billing cycle: your quota resets on each renewal date (for example, a subscription started on the 15th renews and resets on the 15th of each subsequent month). For the Free plan, your quota cycle aligns with your account creation date (for example, an account created on the 23rd resets on the 23rd of each month). Once you reach your quota for the current cycle, transcription is paused for the remainder of that cycle, and we notify you in-app of your upgrade options. Unused minutes from one cycle do not roll over to the next cycle — each cycle begins with the full quota for your plan.

Paid plans (Pro and Max). Pro and Max are offered as monthly or annual subscriptions, billed in advance through our payment processor (Creem), which acts as the merchant of record. Current pricing for each tier is shown at conelab.ai/voice before checkout. References to "your paid subscription" in these Terms apply to both Pro and Max unless otherwise specified.

Currency. All prices are listed and charged in U.S. Dollars (USD). If your card or bank account is in another currency, your bank may apply a foreign-exchange conversion and fees that are outside our control.

Upgrades and downgrades. You may upgrade from Pro to Max at any time; the price difference is prorated for the remainder of your current billing period. You may downgrade from Max to Pro at any time; the change takes effect at the end of your current billing period.

How to subscribe. Subscriptions can be initiated either from the conelab.ai/voice pricing page or from within the Cone Voice desktop application's account settings. After selecting Pro or Max, you will be redirected to our payment processor's secure checkout to enter your payment details. Your subscription begins immediately upon successful payment.

Automatic renewal. YOUR PAID SUBSCRIPTION (PRO OR MAX) AUTOMATICALLY RENEWS AT THE END OF EACH BILLING PERIOD (MONTHLY OR ANNUAL, AS YOU SELECTED) FOR THE SAME TERM AND AT THE THEN-CURRENT PRICE, UNTIL YOU CANCEL. By subscribing, you authorize us, through our payment processor, to charge your payment method for these recurring fees. You can cancel at any time as described below; cancellation stops future renewals.

Payment methods. Our payment processor accepts major credit and debit cards and other methods listed at checkout. We do not store your full card number, CVC, or expiration date — these are held by the processor.

Failed payments. If a renewal payment fails, we (through our payment processor) will retry the charge up to four times over the following seven days. During this grace period your paid features remain active. If all retries fail, your account is downgraded to the Free plan; your account, history, and settings are preserved, and you can re-subscribe at any time.

Cancellation. You may cancel at any time from your account dashboard at conelab.ai/dashboard or by emailing hello@conelab.ai. Cancellation takes effect at the end of your current billing period — you keep your paid features until then. After cancellation, your subscription does not renew and no further charges are made.

Refunds. We offer a refund within 14 days of your initial paid purchase (Pro or Max) if you have used less than 60 minutes of transcription during that period. Renewal charges (after the initial purchase) are non-refundable except where required by law. Refund requests outside these terms are reviewed case-by-case at our discretion. To request a refund, email hello@conelab.ai.

EU/UK consumers — statutory withdrawal right. If you are a consumer residing in the European Economic Area or the United Kingdom, you have a statutory right to withdraw from a digital-content purchase within 14 days under the EU Consumer Rights Directive (2011/83/EU) or the UK Consumer Contracts Regulations 2013, respectively. Because Cone Voice is digital content delivered immediately upon subscription, this right is waived when you expressly consent to immediate delivery at checkout (such consent is collected by our payment processor on the checkout page). If you did not provide that consent, you may exercise the 14-day withdrawal right by emailing hello@conelab.ai within 14 days of your initial purchase, and we will refund you regardless of usage. This statutory right exists in addition to, and does not replace, the refund policy described above.

Price changes. We may change prices for new subscriptions at any time. For existing subscribers, we provide at least 30 days' notice by email before any price change takes effect at your next renewal. If you do not cancel before the change takes effect, the new price applies to your renewal.

Taxes. Listed prices may exclude applicable sales tax, VAT, GST, or similar taxes. Our payment processor calculates and collects taxes based on your billing address and remits them as required by local law. Any taxes shown at checkout are charged in addition to the listed subscription price.

California residents — Automatic Renewal Law (Cal. Bus. & Prof. Code § 17600 et seq.). If you reside in California: (i) the auto-renewal terms above are disclosed to you here and again at checkout in clear and conspicuous form; (ii) you may cancel at any time without penalty by the methods described above; (iii) for any annual paid subscription (Pro or Max), we will send a reminder email between 3 and 21 days before the annual renewal; and (iv) any free trial that converts to a paid subscription is preceded by a reminder email at least three days before conversion.

6. Acceptable use

You agree not to use the Service to:

• Submit content that is illegal, harassing, defamatory, or violates a third party's rights
• Process audio you do not have the legal right to process (e.g., recordings of others without consent)
• Attempt to gain unauthorized access to the Service or related systems
• Probe, scan, or test the vulnerability of the Service
• Use automated means to access the Service beyond the purposes Cone Voice is designed for
• Resell, redistribute, or build a competing service using our infrastructure

We may suspend or terminate accounts that violate these rules.

7. Your content

You retain all rights to the audio you submit and the transcribed text you receive ("Your Content"). You grant us a limited license to process Your Content solely to provide the Service. We do not store your audio, do not use it to train models, and do not share it except with the speech-recognition processor required to perform transcription (see our Privacy Policy).

You are solely responsible for Your Content and for ensuring you have the right to submit it.

8. Intellectual property

All rights, title, and interest in the Service — including the Cone Voice application, the conelab.ai website, the ConeLab and Cone Voice names, logos, and underlying technology — are owned by ConeLab. These Terms grant you no rights to ConeLab's trademarks.

9. Third-party services

The Service uses third-party providers for hosting, authentication, payments, and speech recognition. Their performance, availability, and policies are outside our direct control. Outages or changes in these providers may affect the Service.

10. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE. SPEECH RECOGNITION IS IMPERFECT AND MAY PRODUCE INCORRECT TRANSCRIPTIONS — DO NOT RELY ON THE SERVICE FOR USES WHERE TRANSCRIPTION ERRORS COULD CAUSE HARM (E.G., MEDICAL, LEGAL, OR FINANCIAL DECISIONS).

Force majeure. Neither party is liable for failure or delay in performance caused by events beyond reasonable control, including upstream service-provider outages, internet failures, government actions, natural disasters, pandemics, war, or labor disputes. Affected obligations are suspended for the duration of the event, and we will resume service when the cause is resolved.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONELAB IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

Some jurisdictions do not allow these limitations, in which case they apply to the extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless ConeLab from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we are required to do so by law. Sections 7 (Your Content), 8 (Intellectual Property), 10 (Disclaimer), 11 (Limitation of Liability), and 12 (Indemnification) survive termination.

14. Changes to these Terms

We may update these Terms. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

15. Governing law and disputes

The Service is operated by an individual sole proprietor based in the People's Republic of China.

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict of laws principles.

Notwithstanding the above, if you are a consumer residing in the European Economic Area, the United Kingdom, the United States, Canada, Australia, New Zealand, or Ireland, you retain the benefit of any mandatory consumer protection rights granted to you by the laws of your country of residence. Such mandatory rights cannot be waived by this agreement.

Before bringing any formal legal action, the parties agree to attempt to resolve any dispute by good-faith negotiation. To start this process, send a written notice describing the dispute to hello@conelab.ai; we will respond within 30 days.

For disputes that cannot be resolved through such negotiation, either party may bring an action in the courts of the defendant's country of residence.

16. General provisions

Severability. If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or, if it cannot be so modified, severed; the remaining provisions remain in full force and effect.

Entire agreement. These Terms, together with the Privacy Policy and any policies or notices presented to you in-app or at conelab.ai, constitute the entire agreement between you and ConeLab regarding the Service and supersede all prior agreements and understandings on the same subject.

No waiver. Our failure to enforce any provision of these Terms on one occasion does not waive our right to enforce it on a future occasion.

Assignment. You may not assign or transfer these Terms or your account, in whole or in part, without our prior written consent; any attempted assignment without consent is void. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of substantially all of our assets, with notice to you.

Electronic notices. We send legal notices to the email address associated with your account. You agree that such electronic notices satisfy any legal requirement that notices be in writing. You are responsible for keeping your email address current.

Headings. Section headings in these Terms are for convenience only and do not affect interpretation.
